Medical misdiagnosis can be a devastating form of injury. It is a major cause of malpractice and also a major cause of injury. Because the laws regarding medical misdiagnosis are complicated and vary from state to state, it is important to get representation from a New York attorney that is familiar and experienced with cases just like yours.

What Is Medical Misdiagnosis?

Medical misdiagnosis is, basically, when a doctor fails to diagnosis your condition in a timely manner. This can result in receiving treatment too late, receiving the wrong treatment, or not receiving treatment at all. In some cases, patients have died from medical misdiagnosis.

However, you cannot win a medical misdiagnosis case based on a misdiagnosis alone. Several other criteria must be proven, including:
• Proof of a relationship between doctor and patient. You usually cannot sue a doctor who was not hired to treat you. For instance, if a friend gives you the wrong diagnosis over a game of golf, you did not have a doctor-patient relationship.
• Negligence. Doctors sometimes make mistakes. This is not always actionable. You need to be able to prove that the doctor made a mistake because they were not acting according to professional standards of competency and skill. For example, would another doctor with the same training have been able to diagnose this issue?
• Injury. In order to win a lawsuit, you must be able to show damages. These can be medical bills, time off work, compensation for pain and suffering, and more.

It is usually easy to prove a doctor-patient relationship. However, proving negligence and injury can be quite difficult. This is why it is important to be represented by an attorney skilled in these cases. These attorneys know what proof has convinced judges and juries in the past and can help you to obtain this.

What Diseases Are Commonly Misdiagnosed?

There are several diseases that are commonly misdiagnosed, despite many excellent and accurate tests being available for each. We often see the following conditions missed:
• Cancer
• Heart attack/acute myocardial infarction
• Pneumonia
• Appendicitis
• Embolism
• Internal infections
• Internal bleeding
• Pulmonary embolism

These disorders all can usually be treated successfully if diagnosed in a timely manner. However, grave harm can result if the diagnoses and treatment are missed or delayed. In some cases, more painful and extreme measures are necessary in order to treat the disease when it is finally identified. In other cases, the disease is successfully treated but permanent physical damage has occurred. Sometimes the patient has to live in pain for longer than they would have if medical diagnosis had been accurate and timely. And, in some cases, the patient dies due to their doctor’s mistake.

Types of Medical Misdiagnosis

There are several types of medical misdiagnosis. This type of medical malpractice is not always as simple as merely picking the wrong disease.
• Wrong diagnosis. This is the type of misdiagnosis that most people are familiar with, in which a doctor makes an entirely wrong diagnosis. For example, if a person came into the emergency department with appendicitis and was diagnosed with a stomach flu, the doctor has made the wrong diagnosis.
• Delayed diagnosis. This is when the correct diagnosis was made, but not in a timely manner. If the same patient in the former example came back the next day with worsening symptoms and the doctor then correctly diagnosed the appendicitis, this is a delayed diagnosis.
• Missed diagnosis. This is when a doctor fails to recognize a disease. It is actionable if another doctor with similar training would have made the diagnosis. In addition, if a patient has two unrelated conditions and only one is missed, it is still a missed diagnosis.
• Missed secondary diagnosis. In this case, a doctor fails to look for a secondary condition that commonly occurs with the first one. If a doctor found breast cancer, for example, and failed to look for the metastases to the lymph nodes that commonly occur along with breast cancer, they have missed an obvious secondary diagnosis and acted incompetently.
• Missed complications. Some conditions and diseases have common complications that can be dangerous themselves. It is not okay for doctors to fail to prevent, look for, and treat these complications.

Was Your Doctor Negligent?

Much of your case hinges on this question. In order to prove that the physician acted negligently, you must understand a great deal about the process of medical diagnosis.

A competent physician uses a system called differential diagnosis to narrow down a patient’s condition and ultimately make a firm diagnosis. This means that they mentally list all reasonable diagnoses that a patient could have. They then narrow down the diagnosis and exclude conditions that are contradicted by signs, symptoms, and the patient’s medical history. If they cannot exclude a reasonable diagnosis, they must test for it in some way before they exclude the possibility.

If a doctor failed to follow this process, failed to include an obvious condition on their list of possible diagnoses, or if they did not do the appropriate tests, they have acted incompetently. Another doctor likely would have acted differently, and the patient would be spared their injury. Your medical misdiagnosis attorney can gather evidence and make a compelling case if you are the victim of this type of incompetent behavior.

In addition, there are some instances of medical misdiagnosis that are not the fault of the doctor. For example, the appropriate diagnostic exams and tests may have been performed, but with inaccurate results due to problems with equipment or problems performing the test. While the doctor cannot be held responsible for this, other people may be held responsible.

The Challenge of Proving Injury

While it might seem easy to prove an injury or harm has occurred, this is often the most complicated part of a medical misdiagnosis case. Perhaps a diagnosis was missed and led to a more painful, extreme, or expensive treatment being necessary. In other cases, there was no tangible harm but the patient will have consequences in the future.

For example, if a heart attack is not diagnosed in a timely manner, the patient may have a larger section of their heart damaged. While this will not immediately change the treatment plan, the patient will have a higher likelihood of more heart problems in the future and even a shorter lifespan. This is legally considered an injury. In some instances, even a few minutes of delay in diagnosis and treatment can have grave and long-lasting consequences.

In some cases, a patient may have undergone unneeded treatments due to a medical misdiagnosis. If these caused even small amounts of harm, such as anxiety or time taken off work, these can be considered a legal injury.

As you can see, proving injury is actually quite complex! It is important to hire a lawyer who is experienced with medical misdiagnosis in New York State to represent your case.

When to Ask for Help

Many patients are not sure whether their condition was caused or made worse by medical misdiagnosis. Doctors, understandably, do not call attention to their errors. Patients are intimidated and often don’t feel comfortable questioning their health care workers. You may not even be sure whether the doctor was negligent. In these cases, it is important to talk to an attorney who is skilled in medical misdiagnosis.
