New York is known for its taxicab service. It’s no surprise that New Yorkers choose a somewhat faster mode of taxicab service, ridesharing. Ridesharing companies such as Lyft are popular in New York. The ridesharing company offers discounted rates, an app to connect drivers and riders and fast service. This fast service may not be the safest mode of transportation.

Contact us immediately for help getting money for your Lyft accident.

New York Driver Negligence in Lyft Accidents

Whether a driver is responsible for the Lyft accident depends on if they were at fault. Being at fault in an accident is called negligence. Negligence is acting or not acting a way another ridesharing driver would in the same or similar situation. The driver may have behaved in a careless or thoughtless manner and caused someone an injury.

In New York, a plaintiff, or victim of a Lyft accident, must prove certain elements to win their case. The plaintiff’s attorney must show:

1. The defendant, or Lyft driver, owed the plaintiff a legal duty. A legal duty refers to a driver operating a vehicle without hurting or injuring pedestrian, passenger and other driver. This element is usually easy to prove because the Lyft driver was operating their vehicle at the time of the accident.

2. The defendant breached the duty to do no harm. When a Lyft driver causes an accident, they’ve violated their legal duty. In legal terms, this is called a breach. An attorney may use expert and witness testimony to prove how the Lyft driver caused the accident.

3. Was the injuries the passenger sustained in the Lyft accident caused by the driver? A plaintiff’s attorney must answer this question in the next element. New York accident law assumes the driver didn’t cause the plaintiff’s injuries. So usually an attorney has to call expert witnesses to testify.

4. The plaintiff incurred damages because of their defendant’s negligence. This is where a plaintiff shows all the bills and other damages associated with the accident. A plaintiff in a successful Lyft accident claim may be paid for their:

• Current, past and future medical expenses
• Funeral expenses if their loved one died in the accident
• Lost wages
• Decrease earning ability
• Mental anguish
• Pain and suffering

You’ve been injured in an accident caused by a Lyft driver. You need to get the money you deserve to cover your bills related to your injuries. Unfortunately, being injured by a Lyft driver is a complicated issue. Contact us today. We have the legal experience to represent Lyft accident victims.

Issues in a Ridesharing Accident

Unlike a regular taxicab service, ridesharing companies often try to avoid paying a victim:

• By Classifying Drivers differently than Taxicab Drivers

Lyft and other ridesharing companies classify their drivers as independent contractors and not employees. Their hope is to avoid being vicarious liable for their driver’s accidents. Vicarious liability focuses on employer responsiblity for their employees’ accidents. If a taxicab driver causes an accident and injuries someone, then the accident victim may be able to sue the taxicab company. Lyft and other ridesharing companies classify their drivers as independent contractors. This means drivers don’t work for the company, but themselves. This helps them avoid liability for Lyft accidents.

• Limited Liability Insurance

The Taxi & Limousine Commission requires ridesharing drivers to have at least $100,000 in personal injury liability insurance. Ridesharing companies often have its own liability coverage. However, they try to limit their responsibility by only covering drivers who were on the clock at the time of the accident. “On the clock” is classified as a driver accepting a passenger trip, picking them up and dropping them off at their destination. A ridesharing company may claim their driver caused an accident while they weren’t working for them. Thus, they avoiding liability.

• No Company Cars

The ridesharing company may try to insulate themselves from a car accident by claiming the driver wasn’t operating a company-owned vehicle. Therefore, the company claims they driver is solely responsible for the accident.

We Want to be Your Lyft Accident Lawyer

A ridesharing company may claim their not responsible for your insurances. That’s not always true. You can sue the ridesharing company, Lyft driver and any other responsible parties. We’ll help you get the compensation you need. Don’t delay. New York limits how long you have to sue negligent parties to three years. Contact us today.
