Spinal & Back Injuries From Car Accidents

No fee unless we win
we work hard for you

An injury to the spinal cord often results from an automobile accident, workplace injury or medical negligence. If you or a loved one has suffered a spinal cord injury, you should see a physician immediately. It is extremely important that your physician evaluate your injury, document your complaints and begin the best treatment plan to help you recover.

In some situations, spinal cord injuries are temporary and only last up to four weeks. There are other injuries, however, that comes with persistent pain because injuries are very severe. When this is the case, you not only need a physician to treat your injury, but you may also need legal representation to hold the negligent party responsible.

Types of Conditions Resulting from Spinal and Back Injuries

Injuries to your spine or back can lead to serious conditions. The extent of the injuries and treatment varies, but will usually require ongoing treatment before a person makes a full recovery.

Compression Fracture – this occurs when severe trauma causes the bones of the spine to break. Typically, vertebral body bone tissue collapses from the strong impact on a person’s body. Other injuries such as damage to the nerve root or ligaments, or spinal cord damage. A person can lose feeling or motion after an injury to their spine.

Treatment usually involves decreased activity, pain medication and wearing a brace. Surgery may also be necessary in rare cases.

Paralysis – injury to the nervous system can lead to paralysis and affect your ability to feel and move. Although paralysis occurs with an individual muscle, the entire region surrounding that muscle is also affected.

Thoracic Spine Fracture – located in the chest area, the thoracic spin has 12 vertebrae. Your ribs are connected to the thoracic spine to protect your heart, lungs and other vital organs. An injury occurs to the upper back from sudden injury or trauma. It may also be the result of poor posture over a period of time or from strain. However, most cases of thoracic spine fracture are caused by auto accidents.

Cervical Spine Injury – since most nerves that affect the entire body passes through the neck, a cervical spine injury can cause serious problems.

Lumbar Spine – five bones make up the lumbar spine that is located in the lower back region. An injury to the lumbar spine is common and may occur from any of the following:

• Sports
• Work
• Auto accidents
• Falls
• Violence

Most serious injuries in the low back region involve fractures to the spine or disc herniations, which can be treated without undergoing surgery. However, you may need surgery if the injury you sustained has left your spine unstable, if your spine collapses or if nerve damage occurs.

Your physician may decide surgery is necessary for a number of reasons. Typically, it is done to provide stability and to take pressure off the nerves. Once the treatment you receive does not relieve the pain, your doctor may recommend a fusion surgery. This treatment involves using screws and rods, and bone grafts to hold the spine together.

Potential Cases from Spinal or Back Injuries

Injuries to the spine or back may occur from one of several instances: medical malpractice, auto accident or a defective product.

Medical Malpractice

If a medical professional injured you during a procedure, and you believe their actions were the direct cause of your injury, you may have negligence claim. To prevail in this type of case, your personal injury lawyer must be able to prove:

• The medical professional had a duty of care
• This duty of care was somehow breached
• You suffered a spinal or back injury
• The breach led to your spinal or back injury

Causation – that the negligent action of the accused was the direct cause of the injury – is the most difficult factor to prove after a spinal cord injury. If you decide to move forward with a spinal cord or back injury lawsuit, your lawyer will gather evidence such as medical documents and procedure notes and interviewing witnesses to prove causation.

Auto Accident

Suffering from a spinal cord injury after an automobile accident may also lead to you recovering damages from someone else’s negligence. Whether it was an act or failure to act appropriately, your lawyer will focus on proving four key elements that are the same in proving negligence after a medical procedure.

Product Liability

In a product liability case where you were injured, the manufacturer can be held strictly liable when its produce is defective even without proving negligence. To strengthen your case, your lawyer must show that your injury resulted from a defect that exists within the product.

Negligence occurs when the manufacturer had a duty to sell safe products; that duty was breached by the manufacturer that knew or should have known about the defect; and, your injuries were sustained because of the defect.

This type of claim is prepared by reviewing the manufacturing process of the company, determine which parts were defective and connect the defect to the cause of your injuries.

Damages You Can Receive in a Spinal Cord Injury or Back Injury Lawsuit

In a lawsuit, your lawyer may be able to help you recover the following damages from a spinal cord or back injury:

• Medical expenses – any bills that are the result of your injury. This includes hospital stay, prescription medication, visits to the doctor and rehabilitation. Any future medical expenses can also be calculated into your compensation.
• Lost wages – time you have spent away from work due to the injuries. Loss of future earning capacity might also be awarded.
• Pain and suffering – you can experience lasting physical and emotional pain after suffering an injury to your spinal cord. Monetary damages for this pain and suffering can also be calculated into your award.
Wrongful death – unfortunately, some injuries to the spinal cord result in death. The victim’s family may be able to file a claim against the negligent party. Damages for pain and suffering, and money to help ease the financial burden left by the absence of their loved one is pursued.

Pursuing Compensation with Spinal and Back Injuries Lawyers

When pursing the negligent party after a spinal cord or back injury, you need a personal injury lawyer who will use evidence that shows the severity of your injury. Many insurance companies want to minimize the results from negligent actions by their insured. Some may even claim that the injury you suffered does not affect your daily life.

While insurance companies and attorneys for the other side make claims against your ruptured disc, you need a legal advocate that will work just as hard to prove your claim. Contact us today so we can begin building your case to make sure your settlement is fair.
