Brain & Spinal Cord Injuries

No fee unless we win
we work hard for you

Injuries to the brain and spinal cord are among the leading causes of death and disability among people of all social backgrounds and ages.

Brain and spinal cord injuries can occur before birth (lack of oxygen due to an entrapped umbilical cord), during infancy (bleeding into the brain from prematurity), childhood (accidental injuries), teens to young adulthood (sports injuries) and maturity (stroke).

Since there are literally hundreds, if not thousands, of combinations that can occur in brain trauma and brain injury, it will be easier to describe these conditions in general terms and save discussion of specific pathologies for other pages.

Brain Injury

Brain “injury” refers to a condition in which there is loss of some of the brain’s normal function that is due to a factor that arises external (outside) to the brain tissue, regardless of whether this external factor is physical (traumatic) or chemical in nature. In this sense, “chemical” could refer to a lack of oxygen, a lack of glucose, or a toxin such as carbon monoxide or lead.

The severity of any brain injury primarily depends on what area of the brain suffers the injury and how fast the medical condition of the brain injury victim can be stabilized. In general, injuries that do not result in an immediate or prolonged loss of consciousness have better outcomes than injuries resulting in longer periods of unconsciousness.

Brain Trauma

Brain “trauma” is the term that is usually reserved for a brain injury that is caused by a “mechanical” or “physical”, force such as a blow to the head or a penetrating injury such as a stabbing injury or a gunshot wound. When discussing brain trauma, it is customary to divide such traumas as being “closed head” or “closed brain” traumas, where “open” refers to a trauma associated with a disruption of the scalp that extends to at least the bones of the skull while “closed head” or “closed brain” traumas describe injuries that do not extend down to these bones.

Spine Trauma and Spinal Cord Injury

Due to the way the bones of the neck and back (the vertebrae) are formed as well as the way that they connect with each other to form the vertebral (spinal) column, spinal cord injury is uncommon in the absence of vertebral trauma. In most cases of vertebral trauma, damage to the spinal cord occurs when a vertebrae is forced out of its normal position and presses against the cord. If this compression is not promptly relieved, it is likely that permanent paralysis will occur.

Although there are some congenital conditions (conditions that are present at birth) that can cause paralysis, most cases of paralysis are due to spinal cord damage which occurs in accidents.

How a Personal Injury Lawyer Can Help Those with Brain and Spinal Cord Injuries

Despite what many people believe, most brain and spinal cord injuries are not immediately fatal. If briefest terms, the victims of such industries often live with their disabilities for as long as 30 to 40 years but require expensive medical care every day until their deaths. Unfortunately, any insurance benefits will expire long before that day.

When catastrophic injuries such as brain and spinal cord injuries occur, justice demands that those responsible for those injuries should bear the financial responsibility of caring for the victims. In these instances, it is essential to retain the services of a personal injury lawyer to represent the interests of victims and their families.

Injuries of the brain and spinal cord are some of the most complex injuries imaginable and this same complexity extends into their related legal matters as well. Only a personal injury attorney will have the background and experience to manage these cases to the benefit of the victims and their families.
